With the liability involved with making children's toys, you must agree to these terms and conditions in order for us to accept your custom order for a children's toy.

1. Acceptance of Terms

Your access to and use of our products and services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all customers, users, and others who purchase or interact with our products. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Product Use and Safety Guidelines

Any custom order children's toy is intended for children under adult supervision only. You acknowledge and agree that:

Children must be supervised at all times when using or around the product to prevent accidents or misuse.
If any sign of damage, wear, breakage, or defect is observed on the product (including but not limited to cracks, loose parts, or discoloration), you must immediately discontinue use of the product and dispose of it safely to avoid potential hazards.
Our products may contain small parts that could pose a choking hazard if not handled properly. Parents or guardians are solely responsible for ensuring the product is appropriate for the child's age and developmental stage.

Failure to adhere to these guidelines may result in injury or other harm, for which Kineo Mountain Woodsmithing and its agents assume no responsibility.

3. Disclaimer of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KINEO MOUNTAIN WOODSMITHING, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS (COLLECTIVELY, THE "COMPANY PARTIES") DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE COMPANY PARTIES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PRODUCTS, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR ANY OTHER HARM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SPECIFICALLY, THE COMPANY IS NOT LIABLE FOR ANY CHOKING HAZARDS, INJURIES, OR OTHER ACCIDENTS RESULTING FROM THE USE OR MISUSE OF THE PRODUCTS, INCLUDING THOSE CAUSED BY LACK OF SUPERVISION, DAMAGE TO THE PRODUCT, OR ANY OTHER FACTOR.

You agree that your sole remedy for any dissatisfaction with the products is to discontinue use and, if applicable, seek a refund in accordance with our return policy (if any). In no event shall the Company Parties' total liability exceed the amount you paid for the product in question.

4. Indemnification

You agree to indemnify, defend, and hold harmless the Company Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the products, violation of these Terms, or any third-party claims related to your actions or omissions.

5. Age Restrictions and Parental Responsibility

Our products are not intended for use by children without adult supervision. By purchasing our products, you represent that you are at least 18 years old or the age of majority in your jurisdiction. Parents or guardians are solely responsible for ensuring compliance with all safety guidelines and for any consequences arising from a child's use of the products.

6. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of El Paso County, Colorado, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in El Paso County, Colorado, and you consent to the personal jurisdiction of such courts.

7. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the products and supersede all prior agreements.
